This will be a 2-part series exploring:
1. Differences between JAMS and other arbitration or mediation forums including pricing, panel selection, highly qualified full time ADR professionals, first class resolution centers to accommodate both mediations and arbitrations, discovery protocol, reasoned awards and appeals, among others
2. Effective experts in JAMS mediations and arbitrations including preparation for mediation, assistance with discovery requests and responses, e-discovery, report preparation, panel appointed experts, testimony experiences, and panelists' feedback on best practices for experts
Hon. Karen Brown Willcutts (Former) combines over 30 years of experience as a trial lawyer, judge, mediator, and arbitrator with her efficient case management skills to effectively and efficiently resolve a wide range of civil litigation matters at JAMS. She is known for her ability to quickly grasp the issues in any legal matter, and is empathetic, persistent, creative, and hardworking. As an arbitrator and special master, she strives to be well prepared, provide the parties with a full and fair hearing as expeditiously as possible and render a timely decision that is in accordance with the law and the evidence. As a mediator, she assists the parties in exploring every possible avenue to resolve their dispute.
Cecilia H. Morgan, Esq. is adept at reconciling the irreconcilable and a highly sought after neutral. Her cases are often hotly contested, multi-party matters pending in multiple courts. Known for her follow-up, one client describes her as a "tireless worker who intuitively knows when and how to apply pressure to obtain the deal." She has conducted more than 2,500 sessions of civil cases and arbitrated over 1000 cases throughout Texas and 31 other states. Ms. Morgan was named one of Texas' Best Alternative Dispute Resolution Lawyers by The Best Lawyers in America in 2008 through 2018. Ms. Morgan also has 40+ years of experience as an attorney and ADR professional and is a respected member of the JAMS employment, energy, health care, and financial services practice groups.
E.J. Janik has over 31 years of full-time forensic accounting services, including accounting, financial, economic, construction, fraud and business dispute consulting, with expert witness experience. He has taken part in over 48 trial/hearing testimonies in eight states and over 80 total expert testimony matters and 11 years of engineering & construction matters. He is also a member of several professional organizations including AICPA, ACFE, FEWA, FVS, NACVA and IBA.
Registration will begin at 4:30 PM, followed by networking, dinner and the program, adjourning at 7:30 PM.
