Tips from the Attorney to Assist the Expert in Preparation for Testimony That Establishes Understanding to, and Credibility With, the Finder(s) of Fact

The successful expert is able to explain the technical aspects of the case to the parties involved so that they gain understanding of the words of art, the facts, and establish credibility and trust with the expert. This program will feature Kristina Pedroso, an experienced attorney from Ericksen Arbuthnot, who will explain how credibility and trust are established, and will offer tips for experts on how to best assess the case prior to engagement, prepare themselves for testimony, and work on their preparation with busy attorneys.

Attendees will leave this meeting with tips on:

  • Crafting a substantive Retainer / Engagement Agreement that protects the expert from loss of credibility by ill-prepared clients
  • Money management relative to the case time frames
  • Various roles when serving as “Consulting” versus “Designated Expert”
  • Due diligence regarding the client, the parties involved, the subject matter versus the expert’s expertise, and the scope of services
  • Content of the evidence shared or not shared with the expert by the retaining attorney
  • Preparation / Practice / Rehearsal and lack thereof
  • Tips the attorney client gives the expert using objections during testimony

Kristina Pedroso

Kristina Pedroso is an associate attorney in Ericksen Arbuthnot’s Oakland/East Bay office. She practices insurance defense, landlord tenant law and estate planning. Kristina is experienced in handling all phases of litigation, including pre-suit, complex discovery, law and motion work, oral arguments, as well as settlement negotiations and mediation. Kristina has experience in landlord-tenant matters, including trial; estate planning, including drafting and funding revocable estate plans; probate matters, including appraisal, obtaining bonds and attending probate hearings; Chapter 7 and 13 Bankruptcy, including appearing at 341 hearings, and drafting motions; and real estate foreclosure defense litigation, from inception to mediation and settlement. She has also handled a variety of personal injury matters and worker’s compensation claims.

Prior to joining the firm, Kristina worked at a bankruptcy and real estate defense litigation firm in Santa Clara, California and had her own estate planning practice in San Diego. Kristina received her undergraduate degree from the University of California, at Los Angeles, and obtained her J.D. from the University of San Diego School of the Law. While in law school, Kristina participated in the mock trial team, the Patient Advocacy Clinic advocating for individuals placed on mandatory psychiatric holds, and the Small Claims Clinic.

Kristina resides in Walnut Creek, California with her fiancé. She enjoys watching horror movies and independent films, bike-riding, and listening to music.
