Juries are made up of average citizens who come into the legal arena under compulsion of law and under the direct control and supervision of judges. Outside of jury duty, jurors are customers who use medical, accounting, legal, and other services with a high level of trust, however, as jurors they take their civic duty very seriously and tend as jurors to be somewhat cynical, holding all professionals to the highest standards of integrity and professionalism. The credibility that professionals have with their non-juror clients is not the same as when they encounter these people as jurors. In court, interaction with jurors must recognize their dedication to their civic duty. The incisiveness of jurors and their ability to acutely evaluate an expert’s testimony must not be underestimated.

Carol Bauss, J.D. 

Ms. Bauss is a Senior Litigation Consultant with NJP Litigation Consulting/West. She advises attorneys on trial presentation and jury selection strategy and works with witnesses to improve their communication skills. Her deep knowledge of juror attitudes, juror bias, and jury decision-making is drawn from her years of experience conducting focus groups, mock trials, and post-verdict juror interviews. She helps legal teams find the human story and universal themes within complex legal disputes. Her background in law and rhetoric gives her expertise in helping attorneys cut through the legal jargon to deliver concise and persuasive messages to the jury and other factfinders.
