Rule 702 (Testimony of Expert Witnesses) has changed; the Rule requires proponents of expert testimony to demonstrate the reliability of the expert’s methods and that each opinion reflects a reliable application of those methods.

New Year - New Rules: Rule 702 Review & Supreme Court Ruling Updates

This presentation will review the recent change to Federal Rule of Evidence 702 (Testimony of Expert Witnesses), the Advisory Committee Report of May 2022, and recent decisions applying the amended rule. It will discuss how trial courts may change their procedures to comply with the rule, issues the amended rule’s language may raise with appellate courts, and how the new language may change state court practices. As time permits, attendees will also receive brief summaries of 2023 SCOTUS decisions that may be of interest to Expert Witnesses from all different fields of practice. 

Participant's Will: 

  • Insight into new requirements for courts to document the reliability of expert methods.
  • Understanding of the “more likely than not” standard for reliable principles and methods.
  • Overview of Advisory Committee findings on unsupported admissibility of expert testimony.
  • Guidance on how experts can assist lawyers in providing clear factual findings for judicial review.
  • Best practices for experts in drafting reports that specifically demonstrate Rule 702 compliance.

James E. Smith is a shareholder with Crain, Caton & James P.C. Jim’s practice principally focuses on environmental, safety, and regulatory matters including defense of enforcement actions,
compliance counseling, and supporting transactions, with trial and appellate experience in state and federal courts, both civil and criminal, and appearances before several state and federal agencies.

While the majority of the practice is environmental, his litigation experience includes intellectual property and construction cases; he is registered before the U.S. Patent and Trademark Office as a patent attorney. He generally represents business organizations, especially in the energy and petrochemical industries.

If a program is cancelled, FEWA will offer a full refund of the registration fees to all registered participants. If the program is rescheduled, registrants will have the option to attend the rescheduled event or receive a full refund if they are unable to attend.

This policy is in accordance with NASBA standards and aims to ensure transparency, fairness, and flexibility in addressing any unexpected changes to program schedules.
